Terms of Service

These Terms of Service govern your use of earthtrek.xyz, including its hiking and trekking calculators and related tools. Please read them carefully before using the Site.

1. Acceptance of terms

These Terms of Service (“Terms”) form an agreement between you and EarthTrek (“EarthTrek,” “we,” “us,” or “our”) governing your access to and use of earthtrek.xyz and the calculators and tools available on it (together, the “Site”).

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you should not access or use the Site.

2. Use of website

You may use the Site for lawful, personal, and non-commercial purposes related to planning and preparing for hiking or trekking activities, unless otherwise agreed with us in writing. You agree to use the Site in a manner consistent with these Terms and all applicable laws and regulations.

We may modify, suspend, or discontinue any part of the Site, including specific tools or features, at any time, with or without notice.

3. Use of tools

EarthTrek provides calculators and planning tools, including but not limited to a Trail Pace Calculator, Hiking Time Calculator, Hiking Difficulty Calculator, and Hiking Checklist Generator (collectively, the “Tools”). The Tools are provided to help you think through trail planning factors such as distance, elevation, terrain, experience, and preparation.

You are responsible for the accuracy of the information you enter into the Tools. The quality of any output depends on the accuracy and completeness of the inputs you provide, as well as the inherent limitations of any estimation model.

4. Calculator estimates

All results produced by EarthTrek’s Tools — including estimated pace, moving time, rest time, total trail time, difficulty ratings, and checklist suggestions — are general estimates based on the information you provide and simplified planning models. They are not measurements of an actual trail, and they are not predictions guaranteed to match your real experience.

Calculator results are not a substitute for your own judgment, official trail information, current weather forecasts, safety guidance, or professional advice where appropriate. Actual trail time, difficulty, and conditions can differ significantly from any estimate due to weather, fitness, group size, trail maintenance, navigation, and many other factors outside our control.

You should always verify trail conditions, distances, and difficulty through official or local sources, and use your own judgment — together with appropriate safety equipment and, where relevant, professional or expert advice — before and during any hike.

5. User responsibilities

When using the Site, you agree that you are solely responsible for:

  • Your own safety, preparation, and decision-making before and during any hiking or trekking activity
  • Verifying trail, weather, and route information from appropriate official or local sources
  • Carrying appropriate equipment, navigation, and safety supplies for your planned activity
  • Assessing your own fitness, experience, and the suitability of a given trail for your circumstances
  • Any decisions you make based, in whole or in part, on information or estimates obtained from the Site

EarthTrek does not accompany, supervise, guide, or provide emergency support for any hiking activity, and you should not treat use of the Site as a substitute for these things.

6. Prohibited uses

You agree not to use the Site to:

  • Violate any applicable local, national, or international law or regulation
  • Attempt to gain unauthorized access to the Site, its underlying systems, or related networks
  • Interfere with or disrupt the operation of the Site, including through malware, excessive automated requests, or similar means
  • Copy, scrape, or reproduce substantial portions of the Site’s content or tools for republication or commercial redistribution without our permission
  • Misrepresent your identity or affiliation, or impersonate EarthTrek or any other person or entity
  • Use the Site in any way that could harm EarthTrek, other users, or third parties

7. Intellectual property

The Site, including its design, layout, text, graphics, logos, and the underlying code of its calculators and tools, is owned by EarthTrek or its licensors and is protected by applicable intellectual property laws, except where otherwise noted.

You may view, use, and share links to the Site’s tools for personal, non-commercial purposes. You may not reproduce, modify, distribute, or create derivative works from the Site’s content or underlying code without our prior written permission, except as permitted by applicable law.

9. Availability of website

We aim to keep the Site accessible and functioning correctly, but we do not guarantee that the Site, or any specific Tool, will be available at all times or free from interruptions, errors, or delays. The Site may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our reasonable control.

We may add, change, or remove Tools or features at our discretion, and we are not obligated to maintain any particular Tool or feature indefinitely.

10. Disclaimer of warranties

The Site and all Tools are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by applicable law. This includes, without limitation, implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

EarthTrek does not warrant or guarantee that:

  • Calculator results or difficulty ratings will be accurate, complete, or suitable for your specific trip
  • The Site will be uninterrupted, timely, secure, or error-free
  • Any trail, route, or condition referenced or implied by the Tools reflects current real-world conditions

EarthTrek makes no representation or guarantee regarding the safety of any trail, route, or hiking activity, whether or not you have used the Site’s Tools in connection with it.

11. Limitation of liability

To the fullest extent permitted by applicable law, EarthTrek and its owners, operators, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising out of or related to your access to or use of, or inability to access or use, the Site or its Tools.

This includes, without limitation, any injury, loss, or damage arising from reliance on calculator estimates, difficulty ratings, checklist suggestions, or any other information obtained through the Site, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the limitations above may not apply to you in full. In such cases, our liability will be limited to the greatest extent permitted by applicable law.

12. Changes to terms

We may update these Terms from time to time to reflect changes in our Tools, practices, or legal requirements. When we do, we will revise the “Last Updated” date at the top of this page.

Your continued use of the Site after any changes to these Terms take effect constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

13. Governing law

These Terms shall be governed by and construed in accordance with the laws of [Insert Governing Jurisdiction], without regard to its conflict of law principles, unless otherwise required by applicable local law that cannot be excluded by agreement.
